Terms and Conditions

These Terms and Conditions ("T&Cs") govern all agreements between you ("Customer") and Reef Zlements ("we," "us"), located at 26-28 Alfric Square, Peterborough PE2 7JP, UK, registered in England and Wales (Company No. 12835606), via our websites www.icp.reef-zlements.com or www.zlements.com ("Website"), unless explicitly agreed otherwise in writing.

Scope
1.1. These T&Cs exclusively govern contracts between the Customer and Reef Zlements through the Website.
1.2. Any conflicting or supplementary terms from the Customer are not binding unless explicitly agreed by us in writing.
1.3. These T&Cs apply to both consumers (individuals not acting for business) and businesses (entities or partnerships acting commercially).

 

Our Services

2.1. Our services are solely for Customers who lawfully possess a Reef Zlements water test kit ("Test Kit"), including but not limited to: ICP Saltwater Only, ICP Saltwater and RO, Advanced ICP Saltwater, Advanced ICP Saltwater and RO, and ICP OES/MS. Proof of purchase may be required. 2.2. We provide, via the Website, registration, account services, virtual aquarium management, laboratory analysis of Customer-provided water samples, and non-binding suggestions for correcting water parameters. We do not guarantee the physical condition or outcomes of Customer aquariums. 2.3. Each Test Kit includes barcode labels for sample registration. Samples must be collected and shipped per provided instructions. We aim to deliver sample results within 24 hours after receiving the samples, but do not guarantee any specific service level agreement (SLA) regarding the timing of results. 2.4. Our services may change or be restricted without prior notice. Liability for data loss is excluded; separate data storage by the Customer is advised. 2.5. Our services are restricted to countries listed on our Website: https://www.zlements.com/where-to-buy-reef-zlements. Website access from other locations, including through VPN, is prohibited.

 

Customer Responsibilities
3.1. Customers are responsible for tracking their sample deliveries before contacting us for updates on testing results. We do not accept responsibility for delivery issues or delays caused by third parties.
3.2. Customers must maintain accurate registration and account data and ensure account security. We are not liable for misuse, loss, or password security breaches.

 

Contract Formation
4.1. Presentation of our services on the Website is an invitation, not a binding offer. Sending a water sample constitutes an offer by the Customer. Contracts become binding when we accept samples via email confirmation or by providing the analysis results.
4.2. We do not store contractual documents post-contract.
4.3. Customers bear all shipping risks until samples are confirmed as received by us.

 

Measurement and Suggestions
5.1. Aquarium maintenance is complex, influenced by numerous factors. We provide measurement snapshots, not guaranteed conditions. Liability for specific aquarium conditions is excluded.
5.2. Accuracy depends on proper sample collection and handling; we exclude liability for measurement inaccuracies or sample quality.
5.3. Results and recommendations are general and cannot substitute professional, on-site analysis.
5.4. Corrections to measurements may occur within 72 hours post-issuance; Customers are advised to delay implementing recommendations during this time.

 

Website Availability
6.1. Continuous Website functionality is not guaranteed. We exclude liability for hardware or software failures.

 

Intellectual Property
7.1. Customers are granted a limited, non-transferable, revocable license to use Website functionalities under these T&Cs.
7.2. Reproduction or distribution of Website content without written consent is prohibited.

 

Customer Publication
8.1. Customers may publish their test results publicly, acknowledging data may become accessible to third parties.

 

No Additional Support
9.1. Beyond specified services, we offer no additional free support or advisory services. Customers assume responsibility for actions based on provided recommendations.

 

Limitation of Liability
10.1. We accept liability solely for intentional or grossly negligent breaches. Liability for negligent breaches of essential obligations is limited to the cost of the Test Kit.
10.2. Indirect or consequential damages, including loss or death of aquarium livestock, are excluded.
10.3. Exclusions do not affect liability for personal injury or death nor statutory obligations under product liability laws.

 

Consumer Cancellation
11.1. Consumers retain statutory cancellation rights per applicable UK consumer laws.

 

Final Provisions
12.1. Amendments to these T&Cs must be made in writing.
12.2. English law applies exclusively, excluding UN Sales Law (CISG).
12.3. Disputes shall be resolved exclusively in courts of Peterborough, UK.
